Builder not forming society even after 75% occupancy.

I own a flat in Pune, Maharashtra. Its been more than 4 years I received the possession. Builder had secured the maintenance charge for 2 year at the time of booking. Now after 4 year he is asking for additional maintenance and showing debt of 25 lakhs in society account. All the member of society feels like is he cheating and like to take charge of society. The occupany is more than 75% for 3 existing buildings and 4th one is under construction. Can you please advise if we can form a society considering 3 building occupancy?

This is my response to you:
1. The builder should form society after 60% occupancy has been obtained;
2. Ask him for the bifurcation of the maintenance costs;
3. If members feel that the builder is cheating them approach RERA if the project is rera registered?
4. Consult a local lawyer and take steps.
