Builder denied for terms which he promised earlier for the purchase
27-Nov-2023 (In Property Law)
1st Payment at time Booking itself stopped: Builder/Broker promised certain terms and conditions as i wanted. After issuing cheque he gave me receipt but did not mention those specific terms and conditions which I wanted and which he promised. I afterwards stopped cheque payment by instructing my Bank. Will this type of 'Stopped payment cheque" be treated as an offence?...kindly reply....Thank you. I have no outstanding debt and owe nothing to the builder/broker.
Hi,
You need not worry until.you get a Legal notice from the builder.
They may want to press charges against you to extort money but need not worry.

If we look at this situation technically n legally then builder/broker can file a cheque bouncing case under sec 138 N I act but at the same time we can also file a case in consumer court against the builder/broker for not fulfilling their commitment which they made at the time of booking and at the same time we can file a complaint against the said builder/ broker in Real Estate Regulatory Authority
No this stop payment is not an offence as you was not under legal obligation to pay any due. Your booking would be cancelled by the builder for non receipt of payment but he can not take any legal action against it.
if you have signed an agreement with the builder then he can book you for a breach of contract and also 138 NI Act. you should immidiately intimate the builder and opt of of the contractual terms or else you can be sued
Yes this instruction given by you to the bank to stop the payment of cheque can be treated as an offence. You must contact the builder and disclose your grievance before he takes any legal action against you in case cheque gets dishonoured.
