Since u r staying with ur grandparents n u r dependent on them n ur mother is staying in her matrimonial home, legally speaking u don’t have any rights to force on ur grandparents that they should get ur mothe inside their home. In such cases it is only the aggreived person i.e ur mother who has legal rights to enforce in against her husband
Q: Child custody and alimony after divorce on ground of cruelty
Hi, I have been married over the last 6 years, have a baby boy also ( 4 years old). Want to take a divorce from my husband, because of his cruel behavior, bad habits( alcoholic, gambling, irresponsible father.) He is working in an MNC and have a good income but, not paying as much to me and even not respects for me and always have an ego. I am not working anywhere but wanna take a divorce from my husband. In this case, shall I get the custody of my child and also get some monthly money and divorce. What is the procedures to apply in this case?

Yes mam u r entitled for maintenance also from ur husband and u can also get the custody of ur child but for all this we have to adopt a legal procedure. U have to file a maintenance petition along with the divorce case and a seprate petiton needs to be filed for seeking the custody of your child.
Q: Appeal against sessions court order of allowing Revision Petition
I filed criminal case against 4 accused , out of which two accused filed a revision petition against the trial courts order of issuing summons to them. The sessions court allowed the revision petition and set aside the order of trial court and two of the accused got their names removed from the trial. I want to know that can I appeal against the sessions court order in which they have allowed the revision petition. Will it be possible to get the names of the two of the accused again included in the trial. To which court should I go for appealing ?

U can challenge the order of session court in high court against the acquittal of the said accused person. In my opinion State will also against this order in high court. U can file a criminal appeeal in high court challenging the order of session court.
Q: How to get government lawyer in case of section 498
I filed an FIR section 498 against my husband but no action has been taken yet. My mediation case is also pending in court and only 1st motion is completed yet. I want to hire a government lawyer as I am not financially strong so what is the procedure to get a government lawyer, please suggest. Mam first of all I would like to know from u that who has suggested to hire a government lawyer n what relief do u think a government lawyer can seek for u which a private lawyer cannot get. Secondly mam Government lawyers has no role to expedite the proceedings in ur case since ur husband must have hired a private lawyer n this case is not against the state, it is between two private individuals. Mam divorce proceedings with mutual consent takes it own time i.e approx 1yr or may be little more then that.
Q: Right of a son to claim property of mother
My grandmother had purchased a which was gift deed to my mother and now the said property is now registered in the name of my mother in records of DDA, MCD. We are 2 brothers & 1 sister. My brother is not in talking terms with my mother for years and neither has been taking care of them in their old age. He stays abroad and me & my sister are taking care of my parents. In lieu of above my mother wants to gift deed the property to me and my sister without giving any share to my elder brother OR she wants to sell the property and gift the earnings to me & my sister. Please advice in either of the above scenarios, does my elder brother have the right to claim anything from the said property? Let's say if my mother sells the property & does not give anything to my elder brother then can he claim anything in future? If she gift deeds the property to my & my sister's name, then can he claim anything?

It is advisable that u first ask your mother to make a registered will before Sub Registrar wherein she can disclose her will to whom she wants to give this property, as u have stated that she wants to give equal share to u n your sister in the said property she can do so through her will and thereafter acting in accordance of the will made by your mother in favour of u n ur sister u can go for mutation proceedings in order to get your n your sister name mutated in the records of DDA & MCD. Gift deed is also a option that can be exercised by your mother in order to relinquish her rights over the said property but since u have mentioned that your elder brother stays abroad and your mother does not want to give any share to him from her property in that case he can create some problems after this gift deed is executed in your favour, therefore in my opinion it would be advisable that u get a registered will of your mother in presence of two independent witnesses and then get this will probated from the court of District Judge in order to authenticate your document.
