bses denied electricity connection for mcd booked floor.

Dear Sir, My name is Anurag Sethi.We constructed 3rd floor on our building and total height of our building is less than 15 mtrs.But mcd does not sanction plan in our area Sriniwas puri,New Delhi even thought it comes under authorized colony.Later we got to know that Mcd hs booked our floor for unauthorized construction and have sent notices to bses and sub registrar offices to not grant electricity connection and put a red stamp respectively.Sir how to get it cleared.And can Bses deny an electricity connection when it is considered our extended fundamental right.

Hi.
1. We need to see the By Laws which permit/prohibit construction of third floor.
2. Bses is well within its right to not grant connection but in this case it will have to be seen why reasons are being given by BSES.
3. We can approach BSES and make our case. If still they do not give separate connection, we can approach the Court and relief will definitely be provided.

If you are constructing flOOR you have to get the approval from MCD via sanctioned planed n MAP. Yes MCD has right to demolish your floor, n further notify other authorities too.
It doesn’t effect your fundamental tight bcoz you can have fundamental rights over illegal thing.
The first thing u should do is to reply to the notice which has been sent by MCD otherwise they will come any time to demolish the said floor with police n u won’t b able to do anything

If your building comes under the authorized colony and no issue in respect of the height of the building and everything are accurate. In such case MCD can't take action against you and you may file online complain against MCD and case may be filed in MCD Tribunal.

There is a process and procedure to challenge the notice sent by the MCD wherein BSES will be made a party. What does the notice describes and how are they alleging it to be a unauthorised colony? Share the letter sent by them.

hello client as i can see your issue is serious i agree but in your matter things can get sorted out and MCD can unbook your flar for unauthorised cinstrution and gmyou will be able to get eletricity connection as well as other services but it will go through court only tyem it can be sorted out.

If the extension of the property has been done as per the rules and regulations then MCD cannot take any coercive action against you. Also BSES can act on the directions of the MCD.
