Wife is not ready to give divorce

Hello, i am sunni Muslim got married in 2019, i was not happy with my marriage as i love someone else but due to family pressures i got married but i am unable to accept her, since Oct 2019 we both are living separately i had told her many a time for mutual divorce but she is not ready to give? She just claim in me that i am wrong on all side wherein she never called me nor had a conversation with me. She wants me to suffer like this and i want to end it and move ahead pls suggest what can i do. I am damm stressed

Well, there are several grounds based on which you can seek Divorce despite she is not willing to give Divorce to you. These grounds are available as per the Muslim Personal Law which is in existence in India.

Sorry to know about your situation. It would have been better to convince her and get mutual divorce through a notarized talaqnama but as she is not ready then you will have to send her talaq three different times through a notice...

It's good that you have taken efforts to resolve the issue between both of you but no positive result came out then you can file petition to seek divorce from your wife if still there is problem and she is not ready to take divorce. in your petition you can even claim custody of your child.

it's good that you taken efforts to save your marriage but still the problem persists between the two of you. You can file petition in the court to seek divorce from your wife based on mental cruelty. you can also ask for the permanent custody or visitation of your child.

File a petition in court on grounds of cruelty. Hire a lawyer who can guide you throughout. send a legal notice to hire. alongside make provisions ofr your child.

first you have to give one legal notice to your wife. Then you can file for a divorce petition against your wife under cruelty and mentally harassment caused to you and your family. As you are a natural guardian u can also get the custody of your child. If your wife and you agree we can also go by mutual divorce
