can i challenged the FIR registered against the accused by the police for not booking for criminal offence.the accused is booked only for rash and neligent driving. victim died due to accient
Sections may added or deleted after FIR during investigation. In your case section 304 A is to added. Even if çhargesheet is filed sections may altered in court at the time of framing charge. Even if any evidence comes before court it may be done during trial. So don't worry ask I o do do so

Yes you can but not at this stage, but at the stage when the Police files chargesheet before the Court. You have option to file your protest petition/objection to the Chargesheet and you may argue for the addition of that charge with the support of the facts and laws.
