Payment of money as compensation to an accident victim

On 29th June at around 10:30 PM to 11:00 PM, my father meet with an car accident, while he was walking on road. The culprit was about to run, however, nearby people caught him and made him to admit my father in nearby hospital. We filled an FIR against him, now we are demanding cash from him towards the hospital expenses that we have incurred, he is telling that he will pay by cheque as he needs to have some proof of payment. And we do not want to take payment by cheque, because in future he can demand the money back saying that I have given you loan and now you need to repay the amount. So in this case, even if I take payment by cheque what are things that I need to take care, so that in future I do not fall in trouble?
Every vehicle has insurance mandatory, even if it is old vehicle 3rd party insurance are there. For time being any money you can accept, which would be settled against final claim. Take written acknowledgement that the money is to meet the interim medical expenses...

You should file a case under motor accident tribunal. By that tribunal you got your all expenses incurred by you for said medical trearment. And in that case you have to take cheque after order of the honorable teibunal

Since you have filed a F I R and your father is a victim of accidental injuries you are entitled to receive compensation from the car owner. Dont worry about cheque payment and accept the compensation.
But it is advised to file a compensation case in Motor Accident Claim Tribunal since hospital expenses can increase and injury can result in disability.
