motorcycle compensation dispute

28-May-2023 (In Motor Accident Law)
I was hit by a motorcycle early. Both the driver and I suffered from minor injuries. She hurt her knees and her right foot, and her motorcycle was damaged. Since I was not crossing the road using the traffic light, and the driver was driving at a low speed, she claimed that it was all my responsibility for causing the accident, and asked for the compensation to fix her motorcycle. However she indeed has an insurance for it, but she did not want to claim it as her future insurance fee would be increased. She said she was trying to be kind to me already because she is a gym trainer and cannot work for 2 weeks, but she would not claim me for that loss. So is it true that I should take up all my responsibility for the accident? Can I argue not to pay or to pay part of her cost only?

sir if the fir is registered regarding the said incident then you have to bear less liability however damages would be paid by the Insurance company wholly and rest you have to defend your case and have to proof in court that you are not guilty if the offence
