Legal consequences if criminal case is filed with another name

My husband died in Car accident. Lawyer filed third party insurance claim in my and in laws name. He filed case in my name with husband's name and surname as middle name and surname. However, I carry my maiden name everywhere. I did not change my name after marriage. Lawyers suggested to change my name in legal documents like identity cards as I have to open Bank account with that name. Changing my name at this point of time is very difficult. I will have to go through long procedure and it will have to be changed in all legal documents accordingly. Will it create complication if I don't change my name?
If you have got your marriage registered and have marriage certificate with you, then you can open bank account using your husband's name and surname. Bank will allow you to change the name to existing bank account. But now you have to get your name changed on Aadhar card by using marriage certificate for linking it to your bank account.

Case should have been filed with both names anyways nothing much can be added to matters which are sub-Judicated but your Lawyer can probably make an application to the court for amendment of your name stating that you still continue to retain your old name and benefits be transferred to old name itself.
This can be the possibility, kindly check with your advocate.
