How can I compromise with the insurance company

I had filed for fatal accident against a private truck owner but the insurance company lawyer is not attending the matter and now if I want to solve the matter compromise and I also don't know about insurance company lawyer as they haven't attend any matter. So how can I. Contact to insurance company and can compromise
In case the insurance company is not attending the matter before Court after service of notice, in that case you can proceed exparte against the insurance company. After the award is passed and the court is of the opinion that the insurance company is jointly and severally liable to pay compensation then you can file execution proceedings to recover the compensation amount from insurance.

1. If the opposite lawyer is not attending then send a summons through all the modes;
2. If still he is absent then ask the court to pass orders ex-parte;
3. You cannot compromise with the other side lawyer till he does not show up;
4. Since the case is pending in court, you will need to file 'Consent Terms' even if you settle the matter.
