Get involved in motor cycle accident as driver, actually not driving

Someone else taken away motorcycle and hit the others vehicle causing death of driver of other vehicle and ran away. My son who was working in company of owner of vehicle was taken in costudy by police. Vehicle owner ( Company owner ) get the bail of my son. Now one case of compensation is in the Court against Vehicle owner and my son is also become party considering him driver. One other case has begin against my son by state. In actually my son was not driving the vehicle. Can he tell the truth to court at this stage and what way.

why you Not tell the truth in police office in investigation when your son is implant in that case. why your son get bail. if your son has valid driver license than no worry in compensation case. but in state case you facing the trial.
