25-Oct-2023 (In Motor Accident Law)
Hey, Around 2 months back i met with an accident (car) with bike in blind turn of street. Although I used horn of car before took turn but biker was driving to fast he did not slow his speed therefore, accident was met. a lady sit behind biker was injured. As my moral responsibility I rushed to lady to hospital for treatment.I paid (Rs. 7500/) all hospital bill as well as repaired his bike also.even through whole mistake was not mine. After 3 -4 day he started to seek 20k and said pay amount otherwise he will lodge FIR. I thought he was just trying extract money from me so I ignored. After 2 month today, I received call from Police station that FIR has been lodged against me. How i will be ensure that FIR actually has been lodged or it is just a way to extract money fro me ? Whether After 2 month he can FIR against me? he noted my car number and name Moreover, is i get any exemption if L (learning) mentioned in my car glass?

First of all you should note that display of L didn't means that you will be exempt from any liability. The injred person can file FIR after completion of the treatment or after discharge from hospital. You can file an wanted and surrender application before the conserned criminal court. The court will summon the report from concerned police station whether any case has been registered against you or not . If police submit it's report wherein you are wanted in case of accident then you can surrender before the concerned court and obtain bail from the court. Any other information you can contact me for further assistance

Yes ofcourse you can take the benefit of Learning under Motor vehicle Act.
If other party is trying to extract money from you after 2 months of incident then you go to your nearest police station and tell all the facts to SHO with all evidences which u have like hospital slip by which u have paid 7500Rs etc. they will help u and in all these you should indulge an advocate.

Helo,if if FIR has been registered against you in this manner after two months then it shows malafide intention of that person. If there is any chance of settlement then talk to investigation officer regarding this ,if he is not interested then immediately move a writ before hon'ble high court to annexed with all your proof ,evidences and all your fact. I think definitely you will get relief. Thnk ,for more information contact me .
