Complaint filed in name of registered seller against vehicle sold.

I have sold my bike to a know 5 years back. Received Court Summons that vehicle is still registered in my name, to come and appear. Unfortunately, Im unable to find any sales papers. What to do now?

Hi,

With regards to this, if you don't have the papers of sale, but any intimation that you have sent out or received from the insurance company or transport department, even a delivery note would substantiate your bona-fide. However, this would need a detailed investigation as to what is in your possession for the best approach. Please note, that as a seller it was your duty for updating of the relevant records, however if argued correctly, it can be a rectified.

Hi

Go and appear before the court and make submission that you had sold the vehicle 5 years back and you are not been able to trace the sale papers. It will be better if you can get the information as to why the vehicle is involved in the case.

If you are not having any sell papers i.e. Form 29 M.V Act execute at the time of selling the vehicle in the favour of purchaser,receipt of the sold bike and you are still registered owner of the vehicle then you have to face court summon but if the vehicle is insured then you are not responsible / accountable for that.
