Can a victim claim motor accident claim after dismissal of case

Criminal case dismissed, however victim is claiming MaCT of 10 lakh, how can avoid payment of so much. This case has been dismissed because of non evidence. Please help
Criminal and mact proceeding are different. If the involvement of your vehicle is proved then you will be liable to make payment. But if you have insurance policy for your vehicle.. then you can shift burden on them. But for that also, you need to comply with certain court requirements. The procedure in MACT case and Criminal case are different. In the criminal case should be prove beyond any reasonable doubt whereas the claim provision in MACT are welfare provision and should be construed liberly. Therefore despite dismissing the criminal case the claim petition can be persued in claim tribunal. Claim can be.avoided by leading cogent evidence.
