Accident claim for my wife and son who died in the road accident.

My wife (40) and my son (1 year old) and my daughter (9 years old) was travelling in private car with all other family members like wife's sister and son in their own car and my wife's sister son was driver new on highway, to a marriage ceremony in vapi, Unfortunately they met with accident and my wife and my son died, but my daughter survived. The police has registered the case and the driver was at fault like high speed and the left tyre burst and he was not able to control he turned the vehicle steering too much to right, hence the vehicle skid and 3 to 5 roll had taken. Now due to insistence of my wife's sisters husband I did not claim for the accident and given the statement with police. The case will be now put in the court. But after two months I came to know the real intention of my wife's family members. Now can i claim accident for my wife and son. My wife's salary was 18000. please guide with the same.
dear client you can claim compensation for you wife and son under motor vehicle act in the Tribunal against the owner of vehicle and it's insurance company. if their is no insurance policy then you can file against owner of the vehicle.

I will suggest you ways through which you can claim money legally. However for it, you need to revoke your previous statement which you had given to Police. This may spoil your relations with your Wife's Sister's family.
