what are the rights of a tenant related to tenanted property

1.we are living on first floor and second floor allotee does not allow to access for maintaince of water tank that is situated on the top floor ,is top floor allotte has exclusive right as a owner of roof terrace 2.we have projected a 2ft 6inch chajja on first floor i want to ask you sir what is the proper mcd law for it
For analysing the rights of the allottee I have to check the allotment letter but no one can stop you form maintenance of your water tank situated at roof of the building in any case. You have every right to visit your water tank subject to convinence of the owner of the top floor if the separate staire is not available.
