Property damage through water leakage can I take action

10-Feb-2023 (In Landlord/Tenant Law)

I have an area of 60 sqft where I am providing coaching to 9-10 students. Due to leakage from any pipe or drain from the residential flats my institute walls and roof are being damage. I have told 3-4 times to the other residential flats, from which the leakage is coming, to look into this matter and sort out asap. Could I file acivil case against them?

Yes we file a civil suit for mandatory injunction and suit for damages for the walls and for lossess incurred due to drainage of watar. Court has to order to repair the same to the neighbours and lanlord. You have also right to stop to pay the rent.
