Liability of landlord to pay for repair works not caused by tenants

Hi, I am a tenant in a flat for 1 year which is more than 8-9 years old. It has some issues like flush and inverter not working. On inspecting them with plumber and electrician, they told that the issues are because the parts are old and need replacement. Owner says that they were working when the flat was handed over and I need to fix them. So my question here is who should pay for repair work which is because of parts whose life expectancy is over? I believe the owner should fix it and anything which is not working because of incorrect usage, I should pay. Please share the legal suggestion as it could apply for larger fixes too. Also, is 10 percent increment in rent legal or it is just owner expectation? Thanks,

It is for landlord make repairs and pay for the same. You can do one thing you can repair the goods and write a letter claiming repayment of the same. If the landlord refunded to repay you the same. Deduct the same from rent and pay the rent. This may create a dispute but ultimately landlord would have now down. Still problem persists issue a legal notice to him.

This is my response to you:
1. As per the Maharashtra Rent Control Act, the landlord is responsible to fix all the works of the flat and do all the repair work at his cost;
2. You can send him a formal letter to do the works as required by law and the agreement executed between you and him;
3. If he still does not respond then issue him a legal notice drafted by a lawyer;
4. The rent increase can be as per the wishes of the owner but he will need to draft an agreement recording the same.
