Landlord refusing to pay security deposit and not giving agreed rent

Sir, I have rented a shop and paid 1 month advance and two months rent as security.One month's rent was rs16000so in total i paid three month rent.But we never moved ton that shop nor we took keys of that house. We told land lord that we will not not move in that shop in the very first month only. then also he is not giving complete security deposit.He is giving only 10000 rupees saying that rest of money he has given in commission to the agent. And we dont have rent agreement with us nor we signed it.
