In the absence of a lease/tenancy agreement, any tenancy is deemed to be on a Monthly basis and is terminable upon a 15 day notice. So far as the increase in rent is concerned, the same is purely contractual between the parties. It appears that in the given facts and circumstances, the only remedy available is either to pay the rent as demanded or quit possession. However, It must be taken note that you may be dispossessed from your tenanted premises only in accordance with due process of law which might take anywhere from a couple of weeks to a couple of months thereby affording you an opportunity to identify alternate accommodations. Please note that the above advice is assuming that the tenanted premises is in Delhi and the rent payable is above Rs.3500/-. There might be a change in the situation In the unlikely event of the said assumptions being incorrect. Please note that the present opinion/response/reply is in view of the limited facts put forth by you and shall not be deemed to be absolute/exhaustive and is only preliminary in nature.
