landlord demanding eviction in absence of proper documents

due to lack of documents landlord demands 70lacs for surrendering his rights . my ancestors have purchased shop in 1965on words.till today we r paying rent regularly but he says he wants to sell d shop...what can we do ..He has stoped giving rent reciept after 2015.....i have only my shop name in electricity bill.municipality tax is in his name..what can we do

If you and your family have been in continuous tenancy since 1965 and rent is being regularly paid, the landlord cannot legally force you to vacate or demand ₹70 lakhs for surrender without following due legal eviction proceedings under the Rent Act. Even if he intends to sell the shop, the purchaser will take the property subject to your existing tenancy rights. Since he has stopped issuing rent receipts, start sending rent through money order/online transfer mentioning “rent for premises” so that payment proof is available. You may also issue a legal notice demanding rent receipts and, if harassment continues, file a suit for injunction before the competent court to protect your possession and tenancy rights.

If you are in possession of the shop from 1965, your landlord cannot evict you easily, he will be required to file an eviction suit in small causes court to take you out of the possession, also now you need to file a case for declaration, of you as a tenant as the rent reciept will be on your ancestors name, also file an application to deposit rent in court and the landlord cannot sell the shop to another person until you give consent to the landlord.

If you are a tenant since 1965 and paying rent regularly, landlord cannot evict you without due process. Send rent by money order/bank transfer, issue legal notice for receipts, and file suit for injunction to protect possession.

You can file a suit for Declaration and Injunction to protect possession. Long-term tenancy since 1965 and electricity bills are strong evidence. Deposit rent in court if receipts are refused. I hope, you got the due clarity now.
