Q: Child taken out of India after divorce against consent terms

Our divorce was done with mutual consent terms where I got the visitation rights and she got physical custody. Initially all went well but she stated that daughter doesn't want. In 2023, She moved to Australia with my 7 yr old daughter without my consent. Informed via court she has now filed a case asking for changes in decree due to changed circumstances and citing child welfare. It is clearly mentioned in the signed consent terms that she can't take daughter out of the Mumbai jurisdiction.

mention this to your judge, file a contempt petition before the family court that they have not abided by the orders of this courtask for the child to come back to India, if they are citing reasons that they don't have the expense of taking her back ask them you are ready to pay the expenses and you need full custody of your childcite reasons that anyways she is living alone in Australia she cannot take care of the daughter alone, with judgementsReply to her case how can there be a change in decree when you are not consenting for the child moving to abroad you can also ask for visitation rights in india for the whole summer vacation or full custody



Q: Power of attorney can be given from any state

First sign is done for mutual divorce, cooling off period has started.husband was in abroad,he sent POA from there & i was available in person. Now i have to travel abroad but i am in different state from the state where case is registered. Can i give POA from current state(pune) or do i have to visit the case registered state(haryana) ? What is the procedure & document ? How much time it takes? As i have to travel immediately.

no need to travel to haryana contact a lawyer in Pune to draft a power of attorney for the matter and get it notarised and send the poa through courier to haryana, you will need poa receivers photo and aadhar card and keep your adhar card handy for physical verification,usually 1-2 days but you will be needed to show that poa to the family court judge and also attach a copy of it to your divorce petition.



Q: Gift deed regarding flat in dombivli areaa

My father expired in 2021 the flat is yet to be transferred to my mother's name (nominee).My mother wishes to give to me (daughter) through gift deed.Can we directly process gift deed or first I need to trf the flat in mother's name and then proceed.

if your father died intestate without a will then you need to file for a letter of Administration before Bombay High court in which you can get the flat with the consent of your mother on your name, then there is no need to transfer it from your mother's name to your name it will be directly transferred to your name.



Q: Society Harassment And Mental Agony From Secretary

Since may 22 the society members with braggadocio attitude are deciding on their own and making rules and then insulting in the AGM. They are not meeting, and not accepting grievance letters and not replying to calls. Now it has become like a social outcast and mental agony. The letters sent to deputy registrar are not answered from last 4 months and the police station is refusing to file compliant

I have a similar case with me, first of all the AGM should be conducted by using bye-laws of co-operative society which were codified during the formation of co-operative society,The grievances letters should be given to the society if they are not taking the action on it email them asking for follow up but if that is also not answered file a complaint with deputy registrar in your caseyou have already done that, deputy registrar needs constant follow up and proper hearing to be conducted for the orders to be passedThe police will refuse and say this is a civil matter, Write a complaint letter to the police and ask them to take your statement and ask society to give a statement, You can also file a civil suit again the Society for their mischief

My aunt has dementia and is under medical care, she has no children and her sisters are not taking care of her. She has funds which we want to utilise for her and not sure what's the legal way to do it.
