Lady tenant is not vacating flat after expiry of rent Agreement on 31.12.25.
The landlord should first issue a legal notice of termination calling upon the tenant to vacate the premises within a reasonable time and to pay use and occupation charges. If the tenant still fails to vacate, the landlord can file an eviction suit and also claim mesne profits/damages for illegal occupation.
The rent agreement with the lady tenant expired on 31 December 2025. Her continued possession now amounts to unauthorized occupation under the Transfer of Property Act 1882. You should issue a legal notice directing her to vacate the premises within 15 to 30 days. If she fails to vacate, you can file a civil suit for eviction and for recovery of mesne profits or damages before the competent civil court. Her continued stay will also make her liable to pay compensation for illegal use and occupation of the property.
I will strongly advise not to do anything like threatening, cut off the electricity, or any act of forcibly vacating the flat rather we will send a proper legal notice for termination of tenancy under section 106 of TP act. and then file an eviction suit.
