Q: Recovery of advance payment made for purchase of land

I have paid 11 lakh advance for purchase of land in Dehradun. However on submission of paper s to the bank, the loan was rejected stating that the title holder is someone else and land use is not properly defined. Now the person who has taken the advance is not refunding the amount. The paper submitted has the cheque no and amount but it was issued to a broker. Please advise further action for recovery of my money.

You should treat this as both a civil and criminal matter, as the facts indicate misrepresentation and possible fraud. Immediately issue a legal notice through an advocate to the broker and the person who received the advance, demanding refund of ₹11 lakh with interest within a fixed time, citing defective title and unclear land use. Simultaneously you can file a criminal complaint under relevant provisions of the Bhartiya Nyay Sanhita and you can also file an FIR.

Q: Order delivered but no installation

Purchased 2 ACs from an online platform which delivered on 7 April. Installation pending. Technician visited but refused citing 4th floor issue and left. bot platform and brand are shifting responsibility. Now asked to arrange self-installation from the customer care of online platform. Also receiving calls from unknown numbers (privacy concern). Return window closing without installation. Need advice

You can file a consumer complaint regarding deficiency in service if promised services are not satisfactory. Keep the records and evidences of conversations to prove your claim. You can also seek compensation and litigation cost of the complaint.

Q: Unmarried aunt’s paternal ancestral property rights for her nieces

My unmarried paternal aunt died she had paternal ancestral property now my father &his brother should get her property but my uncle is postponing to divide someone said if my father dies before partition of her property then we as married daughters won’t get her property only my uncle’s sons will get that’s why he is postponing. Is it true?

The devolution of rights in ancestral property is subject to personal laws of the person dying intestate, in your case the religion of person died is not mentioned, as the property rights are governed by respective religious laws,customs and practices the only exception is a registered will.
