Employer Not given Form 16 nor has he deposited PF

I was working with a IT Consulting Company Couple of Months Back I was put on payroll with appointment Letter where all the details of TDS were Mentioned ... On Salary Slip they also mentioned TDS Deducted and PF amount deducted .. when I left the Company nor did they provide any relieving letter , I have found out that the employer who has deducted TDS on payslipp actually has not deposited not deposited the Paid PF ...When I raised the Issue he is threatening to take the salary back

You can take legal action for non-deposit of PF and TDS deductions, and the employer cannot threaten to recover salary that was legally earned for your work. I can help you send a legal notice and file appropriate complaints with the PF department and Income Tax authorities.

You may file complaints with EPFO and the Income Tax Department if PF/TDS deducted were not deposited. Keep appointment letter, payslips and bank statements. Employer cannot legally recover salary by threats. Send a legal notice.

Your employer cannot legally recover salary already paid. Non-deposit of PF/TDS is a serious violation. Preserve appointment letter, payslips and bank records. You may complain to EPFO, Income Tax and Labour authorities.
