First of all,
Just launch an FIR against the religare employee after consultation with your advocate for not to admit the material fact which was reiterated by the hospital itself through a correction certificate.
Immediately he take the necessary action

A consumer complaint seeking compensation and stating deficiency in services, can be filed before the appropriate forums. the insurance companies have made it a policy to reject claims of the consumers on very small and pity issues.

We will have a good case on merits.

yes you may approach to the Consumer Forum against this issue or this matter is related to the insurance you may approach to the Permanent Lok Adalat established in your District. Before that there is a blood test related to the smoking kindly done it by approved path lab and attached that test report along with your complaint.

The only remedy for this case is that, you have to file a Complaint Case before District Consumer Forum claiming that the insurance co. rejected the claim without considering the Letter issued by the Hospital. You should have to proof before the Forum by any evidences that your father was not a smoker other than the Letter of Hospital Authority.
