Interstate death. Hindu . Suit for Division Delhi High court . No valid will. What is the time frame of litigation and cost of litigation?

query is not clear and is vague. what is your query? is there any WILL or not? validity and invalidity are separate and distinct issue. limitation is three years if declaration is also sought. cost include notice, court fee will depend upon value of property, publication, miscellaneous expenses like drafting, typing, filing and service expenses. fee of lawyer is discretion of a lawyer. details are required to ascertain cost. if required consult with detail.

File for succession or division, choice is yours. In both way you can take your share in the property. Whereas cost of litigation it will be approximately 1.5 for entire matter and time will be 1 year. All the best

There is no certain time frame in civil litigation ..1 year to 10 or more …! We need to check the property documents n legal heirs in the same ! DHC is for pecuniary jurisdiction! Suit for partition n possession with injunction n damages can be initiated as per the facts !

Without knowing the extent of complexity involved in the matter, no one can give you any reasonable answer. I assume that you are pursuing this litigation through an advocate and not in person. In that case, you should ask your advocate. He is the best person to guide you on this.

Hello Sir.

This is Advocate Shrikant Samantara.

When a person dies intestate and there is no valid will, the property gets devolved into Class 1 Legal Heirs equally according to Hindu Succession Act.

If a family settlement deed is not agreeable among all the legal heirs, partition suit is the only Remedy.

It takes approximately 2 years to Secure decree from a Court or sometimes less, depending upon the circumstances of the case.

Further there is no fixed cost of litigation. Different Lawyers charge different amounts. It depends upon the Lawyer, from whom you are seeking services.

I personally charge an amount of Rs. 1,20,000 for a partition suit normally.
