Will the new judgment by the Supreme Court change the daughter's right
01-Aug-2023 (In Family Law)
Will the new judgement by supreme court on 3 rd feb 2018 will change daughter right if father died before 9 th sep 2015. Hindu religion.
The latest judgement of Honourable Supreme Court in Danamma's case (Feb 2018) holds that daughters are coparceners irrespective of the date of their birth. But this judgement nowhere overruled the earlier SC judgement in Phulvati's case (2015) where the Honourable SC has held that the 2005 Amendment is applicable only if father died after 9-9-2005. So I don't think the new judgement gives the daughters coparcenary rights if father died before 9-9-2005.
