Wife left home saying cordial separation

12-Sep-2023 (In Family Law)
My wife left house with3.5yr kid saying cordial separation. She is a co-owner of the property. She has visited multiple times to take her belonging both in my presence and absence. Now she is asking back the car which is on her name though she doesn’t know driving and again and again she keeps coming to take her belongings. She is working and mutually I have been running the family while she payed car emi and saved for unforeseen circumstances. I don’t intend to file divorce but don’t know what she is up to. Is there a legal way I can stop her by harassing me with multiple unrequited visit as I stay in that home? Hindi family. Wife is an anxiety depression patient almost 2-3 years before marriage, she keeps blaming that I keep finding fault but the fact is I just kept trying to correct the mistakes/negligence. She starts crying for everything I try to correct such as wearing upside down top, lying down after every small argument, lost when we go to mall etc.

Feel sorry to know about your situation. If you wish to continue the marriage and cohabitation with her then you may send her a legal notice through a counsel asking her to continue the cohabitation with certain conditions failing which you may file...

Dear queriest, as per your query you have mentioned that your wife is suffering from anxiety depression and if such is the case you can take up to thr doctor for treatment of the same, and if she is not ready to live with you in her matrimonial house then you have to go legal option that is restitution of conjugal rights under section 9 of Hindu marriage act, since you don't want divorce. for more information in detail kindly contact me.

file a marriage petition under section 9 of hindu marriage act. moreover by filing this petition you would have an opportunity to discuss all the issues before th councilor. and you would get the benefit in each and every case which she would file in future
