wife leaving home with child against wish of husband

24-Sep-2023 (In Family Law)
My wife started argument one fine day. She took argument to next level and we both argued and then she blamed me for it and left me. Now she says she will come back after 6 months. We have small child 07 months only. Now i am missing my fatherhood and being husband. She has been doing this in the past also. Please suggest what can be done. Is divorce feasible on this ground

You have an option to issue a legal notice to her to resume her conjugal rights and fulfill her matrimonial obligations. Further I would advise you to file an appropriate intimation to the concerned authorities enunciating all these facts to save you from future false litigations.

I would suggest you to go and talk to your wife first, sought things out instead of approaching the court, but if u feel things are not working than you can approach the court and file sec 9 of the HMA Restitution of conjugal rights in the court to get your wife back to the matrimonial house. Instead of going for a divorce trying talking to your wife and settling the matter.

Yes , it can be a ground for taking a divorce only if you represent it in that way. First of all , if she has left your company with out any valid reason then you can send her a notice for restitution of conjugal right. Also you can send her notice for claiming visiting rights to meet your child.
