Wife is threatening and blackmailing me

10-Nov-2023 (In Family Law)
I have been married since 10 months ago in which my wife has stayed only 8-10 days atmy rented house nearby my working place(Delhi NCR), here I lives alone and my hometown is in a different city. she is not interested to come to Delhi and pushing me to come Bangalore and stay with me Otherwise she will file false domestic violence against me and my parents and maintenance case against me. This is seriously not fine for me. She calls and messages me that "I will file for divorce and also file too much money against you as maintenance and ruin your life." My life is so simple and wants to live with a simple Indian culture. But she is planning to ruin me and take too much money and marry another guy in Bangalore. Please suggest me my options. Query 1: What I can do to protect me and my parents? Q2: If I file section 9, what would be the reactions from her side? Q3: If she forces me for divorce with maintenance, how I can proceed for divorce only as she is working and well earning.

I have perused the contents of your query and would advise you to file an intallah peshbandi application with the concerned authorities at the earliest possible. Thereafter a legal notice followed by section 9 application be filed. For detailed consultancy you may contact us.

Hi, When you have not stayed in shared house , she cannot file domestic violence against your parents. Yes you can file Section 9 She can file Divorce, but you need not pay the maintenance charges once she is married . Maintenance also depends upon the condition of both the party. From her attitude it seems she is working . You cannot force anybody to live with you , it's sweet will of both the parties. Thanks Ramit Sehrawat Advocate
