Wife gone to her parents home permanently

My religion is hindu. I am from Agra, UP and my wife's parents are in Delhi. My wife has gone to Delhi, with my child of age 8 years, by giving me in writing on a normal paper that she is going permanently with her own will. Now she is demanding for maintenance. What precautionary documents and action should I take to safeguard myself?

If your wife has deserted you without any cause then you may file a petition for restitution of conjugal right as per section 9 HMA. Also can take the assistance from your local police station. Maintenance for the wife can be exempted if she is working enough. However for the child, you would require to pay if he is not in your custody. You can also file for custody of the child. Get urself debarred from all movable and immovable assets , furthermore u can file the case in family court also to get the custody of the child and u cannot be held liable for any kind of maintenance if she had refused to stay with u

The wife is in Delhi and you were married in the State of UP or Delhi? Is there any divorce proceeding initiated on your behalf? I’m an advocate for Delhi Police and would suggest the what can be done to atleast get back the child.
