26-Sep-2023 (In Family Law)
Hindus. My brother has filed nullity of marriage, as she is mentally retarded. Cheating marriage. Wife has come to court only to file vakalath. Not even single hearing she is attending. Her advocate present. Ourside want to cross examine her. But her advocate dragging case without her presence in court. Can we request judge to make her attendance compulsory as this case is related main issue to her mental status? Is there any other option for us?

you have to oppose the adjournments sought by the respondents and inform the court their deliberate intention to drag the case , presence of parties not required for entire proceedings but for particular stages their presence is mandatory.

You can ask for rejecting her evidence since she has not appeared for her cross examination and pass judgment in your favour. If she appears ask for appointment of commissioner by court to detect her mental status which will help your brother to win the case since court will believe the report of commissioner and not medical reports submitted by your brother
