What to do if my aunt gets abandoned by her husband

I need a legal advise for am aunt of mine who stays in tanjavur. Her husband haa abandoned her and 2 kids and my aunt doesnot earn. He is absconding and my aunt is struggling to make ends meet. I would like to know how i can get him to provide for my aunt and my cousins.

your aunt can very well file a maintenance petition for her and also for the children before court, against her husband. Further, if your uncle is missing and couldn't be traced, a habeas corpus petition can be filed in Madurai High Court and his whereabouts can be found.

First you can give complaint of man missing if your uncle is not heard for sometime. 2. You can give complaint against uncle in AWPS police if you know the address and phone number.
After giving mam missing complaint if you are not getting any response from police you can file habeus carpus petition in the high court. If you need any more information please contact me.

Without knowing his whereabouts, your aunt can't move any application for maintenance. If you people know his address then file a maintenance case under Section 125 Cr. P. C for maintenance of your aunt and her minor children. If he is missing from the place, file a complaint for man missing. Police may possibly trace him.
