what is procedure of filing Restitution of Conjugal Rights application

I got married on 07 March 2014. I have one daughter of 1 yr 5 months old. I am working in a central govt org at Faridabad. I belongs from Kakdwip, South 24 Pgs, West Bengal & hindu family. My wife & her parents forcing me not to keep contact with my parents. They also threatened me that they will put me & my parents in jail, if I keep contact further. On 14 April 2017 my wife went to Bengal to her parents & not willing to come to me at Faridabad. Can I apply for Anticipatory bail & Restitution of Conjugal Rights. Is it possible to do these in Faridabad or I have to go to West Bengal? What documents are needed for this? Please suggest me how can I protect myself or solve the problem.

You may file restitution of conjugal rights case in faridabad and you don't have to go to West Bengal.... If she files any type of complaint in West Bengal then you may get bail as a matter of rights ... So also there is no need to file anticipatory bail....

Yes, you can file restitution of conjugal rights from Faridabad where as you mentioned presently residing. You need to move a petition for restitution of conjugal right under section 9 in Hindu marriage act 1955.If they threatened, you can lodge a complaint against them at your nearest police station and this will also help you in further court proceedings..

It is advisable that you file for restitution of conjugal rights petition in the jurisdiction of Faridabad as she lastly resided with you in Faridabad. t Thereafter, you can obtain the decree of the above mentioned restitution of conjugal rights, and in non compliance of that petition by the respondent you may obtain divorce later on. As far as protection thing is concerned you need not to worried about any false litigation,you just relax and have trust in the judiciary to avoid any untoward incident.
