What if I don't respond to Civil summon Issued by Police?

29-Nov-2023 (In Family Law)
Some property dispute going on with my family. In order to threaten me, Opposite party had lodged a false complaint in local police station that I'm not taking care of my elderly mother(75). Police sent me a crPC 160 Summon for investigation. I appeared for the investigation. But opposite party not appeared, So they gave me another summon come back a week later. This is happening repeatedly for the past 3 weeks. Again Police issued me a summon to come this week. I need to travel 300kms to appear on Police station but opposite party is just 6kms away from the station. What should I do now? If I didn't appear what action taken against me?

The police has issued summons under wrong provision for irrelevant purpose. Not taking care of your parents comes within the jurisdiction of the court. Your mother's place of residence is taken as yours as well and accordingly summons was issued repeatedly.

The notice issued to you is 41A CRPc notice. if your not complying the police may arrest you. thus file a dispnse with petition or not to harass petition or try to quash the FIR. if your not complying the summon police will take penal action against you.
