You have a right to maintenance to maintain your life with decent living standards and as you are taking care of the family, you can request the appropriate amount as per expenditure. Threatening cannot be a basis for justification to control expense. You are legally entitled to get at least a minimum of 50,000 rupees for maintaining yourself and your children if you go by orders of the court.

Dear Client, Based upon the inputs, no specific answer can be given to your query. Its anytime better that you consult a office of Marriage Councilor / Lawyer to discuss each and every point in details. Morally Husband is responsible to run the family. Legally - Wife does not have any direct right on the salary of husband. But if case is filed in Court, based upon various factors, wife is entitled for around 30-35% of husband's salary. The percentage may vary based upon various factors(wifes earning/husbands earning/living status/husbands liabilities, etc) Expert Jurist LLP

I have a judgement where in, maintenance can be given, 1/3 and even half of the salary of the husband. But do one thing try to get the salary slip of the husband so that it would be easy for court to allot good maintenance amount.
