What actions can I take if my husband is not paying maintenance

M married n i hv a 2 years old baby. Earlier i was residing with my husband n some time with my in laws bt my in laws behavior is not bearable at all n now my husband is sending me to live with my laws n i don't want that coz they r not supportive. I want to work bt no body can take care of my baby n they r not allowing me to go to my parents home. What would be the legal action i can take.

In the above situation you can file a maintenance case against your husband under section 125 criminal procedure code for yourself and your minor chid and for the ill-treatment made by in-law you can file a criminal case

U should not move to any legal action rather try to keep balance as u have no grievance with ur husband and also if ur husband has sufficient income to run the family there is no need to work. After a few years everything will be right.Try to take ur husband in confidence in family affairs.

IF YOU WANT TO LIVE WITH YOUR HUSBAND THEN LEGAL REMEDY IS TO FILE AN APPLICATION UNDER SECTION 9 OF HINDU MARRIAGE ACT, IN SHORT YOU ARE REQUIRED TO FILE RESTITUTION OF CONJUGAL RIGHTS BEFORE THE COMPETENT FAMILY COURT AND FOR MAINTENANCE YOU ARE REQUIRED TO FILE AN APPLICATION UNDER SECTION 125 OF Cr.P.C BEFORE THE FAMILY COURT.
IN BOTH APPLICATION YOU CAN PRAY TO LIVE WITH YOUR HUSBAND AND ALSO PRAY FOR MAINTENANCE FOR YOURSELF AND FOR YOU BABY

As per urs ur case ur husband is not his responsibilty seriously towards u and his daughter .And u r forced to live with ur in laws who are also not treating u both well.As it seems that giving birth to female baby its all u r facing.Best way is to claim maintaince in family court .As u need legal help and memtal support

See for the purpose of maintaince you will have to approach the principal judge famaily court in whose jurisdiction you reside and make application there and i believe your grievance will be redressed
