Wants to know the time period of case in court if wife is not coming
14-Nov-2023 (In Family Law)
It's almost going to be 3 years of family court case in next January 2018 ,wife is not taking summon from court neither present in court for hearing kindly tell me what is time period of dissolution of this divorce case .how long this case be remain in court .
U can ask ur lawyer to press before the court to proceeed ex parte since ur wife is not receiving summons neither she is appearing before the concerned court clearly shows her intent to delay the court proceedings by using such tactics
Good Afternoon,
Actually there is no specified period under which it should be ended up.
And there is no provision for her personal presence in divorce/civil cases as long as her advocate is coming before the court or court order her.
But, still court has the power to issue bail able warrant first if desire so. And you can also pray before the court to take some action for her presence.

What is the ground of Divorce?
You can request the court for ex-parte divorce, it may only be granted if you are able to satisfy the court that the respondent/wife is willfully avoiding the service of summons.

If your wife is not appearing before the court then your case will become ex parte (hearing without the other party) and thereafter if a decreee of dissolution will be passed after evidence from your side is done. But it is on the discretion of the Court as to when it decides to proceed the case ex-parte. In case the case is proceeded ex parte then the case will be in court for another 1.5 years approx and in case your wife joins the hearing then matter will be sent to mediation and it will take longer time to reach to a decision.
