Hello Sir, There has to be a deed for adoption singed by both the parties and the same has to be registered. In your case this should be done as the mother is alive. There are few requirements those have to seen like capacity of the adopting parents, soundness of mind, etc.

There is whole lot of procedure for adopting a child. As the adoption in India is governed by various laws, which have defines the eligibility criteria for adoption, like how and who can adopt. Firstly, as in your case one of the Biological Parent is alive so they need to file a surrender deed to the Child welfare committee in order to surrender the child and declare him/her legally free to adopt. This process has alot of steps involved, once this will be done only then you can proceed further with the adoption process. In order to know the whole procedure and requirement for the adoption process please feel free to contact. Thank you

Adoption of a child by the consent of the biological mother would be hassle free. However legal formalities needs to be done, like adoption deed consented by the mother and accepted by you, further name/surname change of the child in the birth certificate or any other documents which have been made in prior. For any further legal assistance please feel free to contact Thanks
