Verbal and physical abuse of parents by son over property

27-Jan-2023 (In Family Law)
Son verbally and physically abused his parents, parents made a police complaint on 112 but later withdrew it as they didn't want to ruin their son's career. But the boy again verbally abused parents the next day, so out of fear they left their house immediately and went to their married daughters house. Now the son is residing in their house, he is not agreeing to vacate the house and parents are too terrified to live in the same house with him. The house is registered in the name of that boy's late grandmother. What legal options do the parents have to take back the possession of house and to make their son leave that house? How long can the procedure take? Are parents entitled to receive any maintenance from their son? Can parents take police protection and restraining orders against their son?

your parents will have to take recourse to the remedy available to them under the senior citizens act, if they are senior citizens. under the act, they can not only get their son evicted from their house, but also apply for maintenance

Hello., Firstly., Parents have full right to attain possession of the property. Secondly., Parents are entitled to take maintenance from son. Thirdly., Either a writ petiton can be filed in High court or even a civil suit at lower court can be filed. Depends on Urgency and Capacity of aggrieved. And more specifically an application shall be drawn to DM for urgent effect so that cruelties can be stopped.
