Uncle sold grandfather's property and refusing to share it
09-Jan-2023 (In Family Law)
My father has total 5 brothers, including him and he is the 4th . The biggest brother is dead and 2nd brother is head and he have all the property papers which our grand parents earned and he has sold many of the properties with out permissions and when we ask him to sell the property and give our shares ,he denies it or delays it. What could be the best process to get back what is our part. Advice and further i have to do and what time it will take to get our property.
First check the properties r in whose name, If the properties r in ur grand parents name ur uncle has no right to sell it, as per ur question your family get 1/5share in that property, you file a partition suit in proper court for your share
Good luck
Good luck
HI
It appears that your rights in ancestral properties are getting violated.
Your father/ Yourself should file a suit for partition and claim your share of property.
if you are aware of the buyers who purchased ancestral property from your uncle, they should also be impleaded in the suit
file a partition suit in courts having jurisdiction over your property

Dear sir the best remedy left for you is to file a partition case in court of law and the property will be divided as per law between all the legal heirs till the final disposal court will grant status quo order and your uncle will not be able to further sale the land. I hope u got the answer if in case of further information or help you can contact me.
