Transfer of flat of a lady dying intestate- NOC required.

A flat was transferred in a lady's name vide a Gift Deed by her husband. She died and now her husband asks for transfer of the same, back in his name. She has children from her earlier marriage and a daughter from this marriage too. Are all these children, her legal heirs and are their N.O.C./Hakka Sod Patra necessary to transfer the flat in the husband's name? The husband is Hindu.

In the case wife dies intestate than thr property is transferred accordingly to her legal heirs those are her children and husband and for the transfer of property in the name of only husband NOC or heirship certificate from court is required
