Transfer of Flat held in joint Name on divorce

Flat purchased after marriage in 2003 on self earned money in joint name is now on court advice for/ on mutual consent divorce to be transferred to my spouse name. What is the procedure, expenditure and documents required? How long will it take?

defines divorce as a dissolution of the marriage. For the interest of the society, the marriage or the marital relationship needs to be surrounded by every safeguard for the cause specified by law. Divorce is permitted only for a grave reason otherwise given other alternative

hear now you both are the joint ownrs and if any one wants to quit from property he or she can relinquish his/her rights by the written deed. as well before the familly court.
expenditures are very from the state to state. but as per transper of property laws that must be registered. In mahahrashtra the stamp duty and charges are very few but it depends on the registration officer.

Aa per your query the flat can be transferred in the name of your spouse by executing a gift deed in her favour. Stamp duty is 3% of the market value mentioned in the Ready Reckoner. Registration charges and miscellaneous expenses additional. The drafting execution and registration of the document will not take more than 2 days.
