The procedures & rules for surrogacy in Chennai

06-Jan-2024 (In Family Law)
My sister is married for 10 years. She is facing a medical issue called Thrombosis which caused multiple miscarriages in last 10 years. We have consulted many doctors and we are afraid that any further treatment might affect my sister's health. So, we are trying to look for other options such as Surrogacy. We want to know the rules in our law & the procedures to proceed in Surrogacy. Are there any complications in our Indian law? Kindly brief in detail. Please reach my number in WhatsApp.

Under the Surrogacy (Regulation) Act, 2021, a woman who is a widow or a divorcee between the age of 35 to 45 years or a couple, defined as a legally married woman and man, can avail of surrogacy if they have a medical condition necessitating this option. The intended couple shall be a legally married Indian man and woman, the man shall be between the ages of 26-55 years and the woman shall be between the ages of 25-50 years, and shall not have any previous biological, adopted, or surrogate child

Surrogacy is permissible in India. The parents first need to approach a government medical board. Parents should be between 25 to 50 years of age. They should not have a history of having a child through natural conception or adoption.
