Q: Regarding Ventilation above 10 feet

There was a seperation of house and we got the front side of the house and the opposition got the backside of the house through mediation court.everything got seperated and we started building. So we have a ventilation above 10 feet (the ventilation is facing their path)now the opposition is making demands like we shouldn't have the ventilation .is it legal to have ventilation.

Advocate Gopala Krishnan answered
It is quite legal. No one can question ventilation that you have in your property. Your neighbour can't decide the places where you have to have ventilation in your premises. Give a police complaint against him. If he continues harassment file an injunction suit.

Q: Clarification on Division of Hindu Female’s Inherited Property

Dear Advocate, I seek your opinion on a Hindu female’s inherited property (childless) under the Hindu Succession Act. If the heirs are children of her two brothers, should the property be divided per capita (per head) among all heirs or per stirpes (by branch)? Both brothers are deceased; Brother A has 6 children and Brother B has 1 child. Would the share be 1/2 or 1/7 (6+1)? Relevant sections: 15(2)(a), 16, Rule 3, 19(b), and SC rulings including Bhagwan Dei v. Ajay Kumar (2022). Kindly advise.

Advocate Gopala Krishnan answered
When the property was inherited from her father and she died childless. The property will go back her deceased father and devolve on his heirs. The heirs of the father under Section 8 include his children. Only the children of father will be in count. if children are two-1/2. The grandchildren would receive 1/2 and separate it among their's brothers and sisters, including mother.
