Steps to be taken for division of property equally amongst daughters

25-Mar-2023 (In Family Law)
My maternal grandfather died in 2009 and have not left any will. my grandmother is still alive ( now parallised) and live in house which is still in my maternal grandfathers name.my mother is first daughter and she had 3 sisters. Among rest 3 sisters 1 is still unmarried and staying in grandfathers house. Now the unmarried sister is telling that whole property is her only as she still living in that house. Can she claim the whole property? how property will be divided??will my mother also get share in this property?? What steps we need to take for dividingproperty in name of all daughters equally?

Well you and your mother may have to apply for succession certificate and all daughters shall be entitled to equal share in the property. If you want to divide the property then you may have to file suit for partition and possession by meets and bound..
In this case the property if possible to divide shall be divided otherwise sold and money And your grandmother shall also be entitled to her share... So technically 5 shares...

Dear sir
Thanks for query first thing I like to know ur part of which religion because as per the provision on personal law in India. There is separate way of alienat the property among all heirs. As on today your grand mother is still alive if ur said property is ancestral property then there is different ways to alienate the same property - if this property is purchased by ur grand father in that case ur grand mothers have all sole right to alienate the said property

For more suggestion call me

Thanks
