Share of grandson in the property of grandfather

20-Oct-2023 (In Family Law)
Hi , I have seen many legal advices had been posted and I though this is the best platform where I can get perfect advice. My grandpa was passed away 40 years back and land was owned to four of his son's without patition(I mean combined, four son's are defined as owners combinly). After that one by one all the son's passed away and their legal heirs has been updated in all the property in combinly. now my question is if my grandpa has 1 hectar of land. Shall I get 1/4 hectar as am a lonely son to my father and my father is also owner for same amount. Since it is in combined state,I am worried about the share as I only one to my father but cousins are more to my uncle's. Please suggest the shares to grandsons and what is the provision in over law to make ownership of my mine which is legally mine where the property is with combined ownership with grandsons.

Yes, as per the Hindu Succession Act your father was entitled to 1/4th share in property. On his death you are entitled to the same being the only son. However, if your mother is alive, she shall also have an equal share in your father’s property.
