Seeking legal advice on grounds of mental cruelty

I’m seeking legal advice about a possible divorce. My wife has emotionally distanced herself for a long time and recently stopped speaking to me just because I spoke with my sister. This ongoing behavior has caused me mental stress and is affecting my health and work. I’d like to know if this can be considered mental cruelty under divorce law and what my options are.

Yes, this can be considered under mental cruelty- also depending on how long this has been going on. You can file for a divorce on the grounds of the same if the marriage at this point of time is irretrievably broken. The court jurisdiction shall be decided on where the marriage was solemnised and under what law was marriage registered.

Well, Mental cruelty generally refers to behavior by one spouse that causes mental or emotional pain to the other. The courts interpret mental cruelty based on the severity and impact of the behavior, rather than isolated incidents. This means that for an act to be considered mental cruelty, it should be prolonged, recurring, or of such a nature that it seriously harms the mental health and stability of the victim. So, the emotional distancing of your Wife from you just because you spoke with your Sister doesn't seem to be a valid reason for her to emotionally distance herself from you, hence her act seems as unleashment of Mental Cruelty upon you!

Yes you can file a divorce case for mental harassment caused to you by your wife. As well as send her legal notice in the first instance. You can also file for mediation between both of you through your legal representatives.
