Seeking Divorce on Religious ground of cruelty

07-Jun-2023 (In Family Law)
Hello Sir/ Madam, I am a Hindu, 33 from Kolkata. I got married to a muslim boy through Special marriage act in the year of 2017. From my husband's side no one was there at the time of registry as they never accepted me as their daughter in law as Hindu. But after registration my husband and his family is forcing me to do Nikah and perform all Muslim rituals. My husband refused to have our own kids as I am Hindu and only can happen if I convert to Islam. From registry date to till now , am going through mental harrasment , torture that I cant able to bear. I am now mentally ill and physically as well. I want divorce. But he is not willing to give me . So I have to go for contested. Please guide me, if there is any religious ground of cruelty to get divorce. Thank you.

no choosing a religion is by choice of an individual moreso you cannot be forced into changing your religion moreover you can take steps against husband and inlaws only after fulfilling few criterias so that there are no loop holes and you can penalise them properly

You may file contested divorce case and I am very much sure that you have get decree of divorce easily on the ground of converting the holy religion. Firstly, I suggest you to lodge general diary before the local police station regarding this matter(physical & mental torture) which will prove your case at the time of evidence. Your husband also may not defend him. Consult your advocate & file your divorce case. Thanks with best wishes.
